Basic Provisions 

1.1. For issues not regulated by this Policy and for the interpretation of this Policy, Hungarian law shall apply, with particular regard to Act V of 2013 on the Civil Code ("Civil Code") and the relevant provisions of Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society. The mandatory provisions of the applicable legislation shall apply to the parties without special stipulation.

 1.2. Validity; this is valid until the modification of the General Terms and Conditions (GTC). 

1.3. The webshop is protected under copyright law as a copyrighted work. 

1.4. Availability. Available 365 days a year, 24 hours a day. We will notify our registered users about the suspension or termination of availability 48 hours before the planned downtime and display information in the form of an extra insert on the homepage of the website.

Scope of Purchasable Products and Services 

1.5. The products listed can be purchased both in the webshop and in person (In person: VIM bike and coffee, 1117 Budapest, Bíró László József krt. 17.). The prices listed for the products include VAT. The prices of the products do not include the cost of delivery. The prices for products in the webshop may differ from those in the physical store but cannot be higher than in the physical store. 

1.6. The Service Provider will provide detailed information about the name, description, and display photos of the products in the webshop. The images displayed on the product data sheet may differ from reality and may appear for illustration purposes in certain cases. 

1.7. If a promotional price is introduced, the Service Provider will fully inform Users about the duration of the promotion.

Order Process 

1.8. A detailed description of the order process extends from logging in to placing the product in the cart. 

1.9. Corrections for data entry errors will be made within 24 hours after notification (e.g., adding another product, deleting a product, checking prices, etc.). 

1.10. Description of payment options and delivery methods: Online card payments and other payment methods are processed through the Barion system. The card and payment-related data do not reach the merchant. The service provider, Barion Payment Zrt., is a company supervised by the Hungarian National Bank, with license number: H-EN-I-1064/2013.

1.11. The Service Provider's webshop is obliged to immediately confirm the receipt of the order from the user electronically. If this confirmation does not reach the user within the expected timeframe, depending on the nature of the service, following the sending of the user's order, but no later than 48 hours, the user will be exempt from the binding offer or contractual obligation. An order and its confirmation shall be deemed to have arrived at the service provider or the user when made accessible to them. The parties may deviate from the above rules if they have agreed otherwise.

Processing and Fulfillment of Orders 

1.12. When will the processing of orders happen: We will inform our customers about the receipt of orders and the processing of orders via email within 24 hours. 

1.13. General fulfillment deadline is within 5 working days from confirmation. If the Service Provider and the User have not agreed on a date for fulfillment at the time of fulfillment, the Service Provider is obliged to fulfill the contract within the time specified in the User's request, or, in the absence of a request, no later than within 30 days from the receipt of the order at the Service Provider. 

1.14. If the Service Provider fails to meet its contractual obligations because the product specified in the contract is not available, it must promptly inform the User and refund the amount paid by the User without delay, but no later than within 30 days. This obligation does not exempt the Service Provider from other consequences of breach of contract.

Right of Withdrawal 

1.15. According to Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the User may withdraw from the contract without justification within 14 days of receiving the ordered product and may return the ordered product. 

1.16. The procedure for exercising the right of withdrawal: The right of withdrawal is intended to protect consumer rights both in Hungary and in the European Union. In the case of webshops, customers can withdraw from their purchase without justification within 14 days. The procedure for exercising the right of withdrawal is as follows:

  • Notification: The buyer must notify the webshop of their intention to withdraw. This can be done via email, phone, or by another means specified by the webshop.
  • Return: After notifying their intention to withdraw, the buyer must return the product to the webshop's address within 14 days. The product must be returned in its original condition and packaging.
  • Refund: The webshop is obliged to refund the amount paid by the buyer, including shipping costs, within 14 days. The refund is generally processed using the payment method used for the purchase.
  • Exceptions: The right of withdrawal does not apply to all products. For example, if the product is customized or if the packaging has been opened (e.g., for health or hygiene products), then the buyer cannot exercise the right of withdrawal.
  • Documentation: It is advisable to include an order number and receipt with the return, as this makes it easier to track the process.

Warranty 1.17.

  • Mandatory Warranty: 2 years for electric bicycles, 1 year for pedal bicycles.
  • Content of Warranty: Under the warranty, the buyer has the right to repair, exchange, or a refund in case of product defects, depending on the situation.
  • Warranty Ticket: A warranty ticket is included with the warranty, which contains the purchase date, product details, and warranty duration.

Guarantee

  • Quality Obligation: The guarantee means that the manufacturer or distributor undertakes that the bicycle will be flawless at the time of purchase and will function as intended.
  • Repair or Exchange: If the bicycle breaks down during the guarantee period with normal use, the buyer has the right to:
    • Free repair of the defect.
    • Exchange the product or receive a refund in case of irreparable defects.
  • Duration: The duration of the guarantee varies, typically lasting from 1 to 2 years, depending on the type of bicycle, manufacturer, or distributor.
  • Exceptions: The guarantee does not cover normal wear and tear, improper use, or any external damage, such as damage from collisions.
  • Warranty Ticket: The warranty ticket received at purchase is important, as it verifies the purchase and contains the necessary information for claiming the guarantee.
  • Conditions: The conditions of the guarantee and warranty can be found in the documentation attached to the product or in the General Terms and Conditions provided by the distributor.

Complaint Handling

1.18. Complaints can be submitted in writing via email at vimbike@icloud.com. In Hungarian, German, or English. Responses to complaints will be sent to the complainant within 24 hours via email.

Miscellaneous Provisions 

1.19. The Service Provider and User will attempt to resolve their disputes amicably. The User and Service Provider agree that for any potential legal disputes arising from the scope of this Policy which cannot be settled by agreement within 30 (thirty) calendar days, the jurisdiction of the Capital Court is established.
